Terms & Conditions

1. Definitions

  • "Company" means Hamptons Painting & Decorating.

  • "Customer" means the individual, business, landlord, managing agent or organisation engaging the Company.

  • "Quotation" means the written quotation issued by the Company.

  • "Works" means the painting, decorating, spraying, coating, preparation and associated services detailed within the Quotation.

2. Acceptance

2.1 Acceptance of a quotation by email, text message, written instruction, payment of a deposit or instruction to commence works constitutes acceptance of these Terms and Conditions.

2.2 The Quotation, together with these Terms and Conditions, forms the agreement between the Company and the Customer.

2.3 Quotations remain valid for 30 days from the date of issue unless otherwise stated.

3. Quotations and Variations

3.1 Quotations are based upon the visible condition of surfaces and areas inspected at the time of survey.

3.2 Any hidden defects, damp issues, structural movement, rotten timber, defective plasterwork or other unforeseen conditions discovered during preparation may require additional work and costs.

3.3 Any additional work requested by the Customer after acceptance of the Quotation may result in additional charges and revised completion times.

3.4 The Company will endeavour to obtain approval for variations before proceeding with additional chargeable work.

4. Deposits and Payment

4.1 The Company may require a deposit and/or staged payments as specified within the Quotation.

4.2 Deposits are used to secure booking dates, purchase materials and allocate resources to the project.

4.3 The balance of the quotation shall be due upon completion of the Works unless otherwise agreed in writing.

4.4 For larger projects, staged payments may be required and will be detailed within the Quotation.

4.5 Payment may be made by bank transfer, cash or cheque.

4.6 The Customer shall notify the Company of any invoice query within 7 days of receipt.

4.7 The Company reserves the right to charge interest on overdue accounts in accordance with applicable legislation.

5. Customer Responsibilities

5.1 The Customer shall provide reasonable access to the property during agreed working hours.

5.2 The Customer shall ensure that the work area is reasonably clear of personal possessions, valuable items and fragile objects wherever possible.

5.3 The Customer shall inform the Company of any known hazards, asbestos, structural concerns, water ingress, electrical issues or other conditions that may affect the Works.

5.4 Where parking permits, parking charges or access fees are required, these shall be the responsibility of the Customer unless otherwise agreed in writing.

6. Materials and Colours

6.1 Unless otherwise agreed, the Company shall supply all materials required for the Works.

6.2 Where colours, finishes or products are selected by the Customer, the Company accepts no responsibility for dissatisfaction with colour choice, sheen level or product selection once applied.

6.3 Paint colours and finishes may appear differently depending on lighting conditions, surface texture and drying times.

6.4 Final colour assessment should only be made once products have fully dried and cured.

7. Workmanship

7.1 The Company shall carry out the Works using reasonable skill, care and industry-standard practices.

7.2 The Company will take reasonable steps to protect floors, furnishings and adjacent surfaces during the Works.

7.3 The Company will endeavour to complete the Works within any estimated timeframe provided, however completion dates cannot be guaranteed due to factors beyond the Company's control.

7.4 Minor snagging items identified during final inspection shall not constitute incomplete Works and will be rectified within a reasonable period.

8. Liability

8.1 The Company shall not be liable for defects arising from pre-existing conditions, damp, structural movement, defective plaster, previous coatings, timber failure or other conditions outside its control.

8.2 The Company shall not be liable for delays arising from adverse weather, restricted access, material shortages, actions of third parties or events beyond its reasonable control.

8.3 The Company shall not be liable for defects or failures arising from customer-supplied materials.

8.4 Nothing within these Terms shall exclude liability for death or personal injury caused by negligence or any liability that cannot legally be excluded.

9. Insurance

9.1 The Company maintains appropriate public liability insurance.

9.2 Customers are responsible for maintaining adequate insurance cover for their property, contents and possessions.

10. Cancellations

10.1 The Customer may cancel the project by providing written notice.

10.2 Where materials have been purchased or costs incurred, the Company reserves the right to retain all or part of any deposit to cover reasonable costs and losses incurred.

10.3 The Customer shall remain liable for any completed work and materials supplied prior to cancellation.

10.4 The Company reserves the right to cancel or postpone works due to illness, injury, adverse weather, material shortages or circumstances beyond its reasonable control.

11. Defects and Complaints

11.1 Any concerns regarding the Works should be notified to the Company as soon as reasonably practicable.

11.2 The Customer agrees to provide the Company with a reasonable opportunity to inspect and remedy any verified defects before instructing third parties to undertake remedial work.

12. Photography

12.1 The Company may photograph completed works for portfolio, marketing and social media purposes.

12.2 No personal information or identifying customer details will be published without consent.

13. Force Majeure

13.1 The Company shall not be liable for any failure or delay caused by circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, industrial disputes, government restrictions or supply chain disruption.

14. VAT

14.1 Hamptons Painting & Decorating is not currently VAT registered and therefore VAT is not chargeable unless otherwise stated.

15. Governing Law

15.1 These Terms and Conditions shall be governed by the laws of England and Wales.

15.2 Any dispute arising in connection with these Terms and Conditions shall be subject to the jurisdiction of the courts of England and Wales.
